Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("Policy") forms part of the FlockPack Terms of Service.

FlockPack is designed to support community organisations, clubs, charities, schools, faith-based organisations, cultural associations, event organisers, volunteer groups, home-based businesses, and small businesses in managing registrations, memberships, events, competitions, sponsorships, fundraising activities, donations, bookings, attendance, and related administrative functions.

By using FlockPack, you agree to comply with this Policy at all times.

2. Permitted Use

FlockPack may be used for lawful activities including:

  • Event registrations and ticketing
  • Membership applications and renewals
  • Community programmes and activities
  • Volunteer management
  • Sponsorship programmes
  • Fundraising campaigns
  • Donations
  • Competition registrations and participation
  • Attendance tracking
  • Surveys and polls
  • Booking management
  • Educational programmes
  • Club and association activities
  • Cultural and faith-based activities
  • Home business activities
  • Home baking and home kitchen orders
  • Food sales associated with an organisation or event
  • Merchandise sales related to an organisation's activities
  • Products and services offered directly by the account holder

3. General Responsibilities

Users must:

  • Comply with all applicable laws and regulations.
  • Provide accurate and truthful information.
  • Use FlockPack only for legitimate business, organisational, or community purposes.
  • Maintain required licences, permits, registrations, and approvals for their activities.
  • Ensure products, services, events, and activities are delivered as advertised.
  • Comply with payment provider requirements and policies.

4. Prohibited Activities

You must not use FlockPack for:

Illegal Activities

  • Any unlawful activity.
  • Fraud or deceptive conduct.
  • Identity theft or impersonation.
  • Money laundering or financing illegal activities.
  • Violations of sanctions or trade restrictions.
  • Misleading or fraudulent fundraising campaigns.

Platform Abuse

  • Uploading viruses, malware, or malicious code.
  • Attempting unauthorised access to systems or accounts.
  • Interfering with platform operations.
  • Scraping or harvesting user data without authorisation.
  • Distributing spam or unsolicited communications.
  • Circumventing security controls.
  • Creating fake accounts.

Misrepresentation

  • Misrepresenting products, services, events, organisations, or activities.
  • Providing false business information.
  • Using another person's identity.
  • Misleading participants regarding pricing, refunds, events, or fundraising purposes.

5. Marketplace Restrictions

FlockPack is not intended to operate as:

  • A general-purpose online marketplace.
  • A multi-vendor marketplace with unrelated sellers.
  • An auction platform.
  • A wholesale trading platform.
  • A classified advertising platform.
  • A dropshipping platform.

Users must not:

  • Process payments on behalf of unrelated third parties.
  • Allow unrelated businesses to sell through their FlockPack account.
  • Conceal the true nature of goods, services, or transactions.
  • Use their account to aggregate payments for multiple independent sellers.

6. Restricted Products and Services

The platform must not be used to offer, promote, distribute, or facilitate:

  • Illegal drugs or controlled substances
  • Counterfeit goods
  • Stolen property
  • Weapons, firearms, or ammunition
  • Explosives
  • Pyramid schemes
  • Ponzi schemes
  • Fraudulent investment opportunities
  • Money transfer services
  • Unlicensed financial services
  • Any goods or services prohibited by New Zealand law

FlockPack reserves the right to determine whether an activity presents an unacceptable legal, financial, reputational, or operational risk.

7. Payments and Financial Information

Users must not collect or store through standard FlockPack forms:

  • Credit card numbers
  • Card security codes (CVV/CVC)
  • Internet banking passwords
  • Banking login credentials
  • Security questions or authentication codes

All payments must be processed through approved payment methods and integrations.

Users must not:

  • Manipulate transactions to avoid compliance requirements.
  • Circumvent payment provider policies.
  • Process transactions that do not relate to legitimate goods, services, registrations, memberships, donations, events, or activities.
  • Conduct transactions on behalf of unrelated third parties.

8. Compliance with Payment Providers

Where payment functionality is enabled, users must comply with all requirements imposed by:

  • Stripe
  • Windcave
  • Worldline
  • Banking partners
  • Other approved payment providers

FlockPack may suspend payment functionality where required by a payment provider, regulatory authority, financial institution, or applicable law.

9. Verification Requirements

FlockPack may require users or organisations to provide information to verify:

  • Identity
  • Business ownership
  • Legal status
  • Charity registration
  • Incorporated society registration
  • NZBN details
  • Banking information
  • Authorised representatives

Failure to provide requested information may result in restrictions, suspension, or termination of services.

10. Monitoring and Enforcement

To protect users and maintain platform integrity, FlockPack may:

  • Investigate suspected violations.
  • Request additional information.
  • Remove content.
  • Reject transactions.
  • Restrict platform functionality.
  • Suspend accounts.
  • Terminate accounts.
  • Report activities to payment providers.
  • Report activities to regulatory authorities or law enforcement where required.

Action may be taken without notice where reasonably necessary to protect users, payment systems, or the platform.

12. Changes to this Policy

FlockPack may update this Acceptable Use Policy from time to time.

Updated versions will be published on the FlockPack website and become effective upon publication.

Continued use of the platform after publication constitutes acceptance of the updated Policy.
